Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Women in Africa (the Maputo Protocol), the only regional human rights treaty focusing broadly on women’s rights, speaks to the diverse realities of women and girls in Africa. Jaslika has convened a multi-sectoral panel of experts to discuss this Protocol, building on insights and issues emerging from the Legal Commentary on the Maputo Protocol focusing on article 12 on the Right to Education. Published by the Pretoria University Law Press in 2023, the publication provides systematic analysis of each article, drawing from the initial and periodic reporting done by member states as required by the Maputo Protocol and the African Charter, as well as the work of other international and regional treaty bodies and courts, supplemented by examples from domestic jurisdictions where domestic courts have interpreted and applied the Protocol.
Our panel of experts will:
Share an overview of the book, briefly explaining what a legal commentary is, and the importance of the Maputo Protocol for the advancement of women and girls in Africa
Highlight actions taken by various African countries to implement the provisions of article 12 on the Right to Education and the persisting challenges
Spotlight the role of Kenya’s National Gender and Equality Commission and its role in monitoring compliance to the Protocol, and their insights on Kenya’s compliance with the implementing provisions of article 12 and related articles (e.g. on Child Marriage)
Perspectives of civil society actors and researchers on the application of the provisions of the Maputo Protocol to end discrimination against marginalised/excluded women and girls in and through education in Kenya.
